Good grief

Looks like a developer of a 14-unit building near the South Bay Mall is in a bit of hot water with the Boston Planning and Development Agency for selling two affordable units for market rate.

Universal Hub is reporting a lawsuit was filed on Tuesday in Suffolk Superior Court asking the court to order the “disgorgement of all rents, profits, or proceeds Defendants have collected by selling the Affordable Housing Units in excess of the Maximum Resale Price.” The BPDA also hopes to be awarded triple damages.

The 5-story building in question is located at 85-93 Willow Ct., off Allstate Road. The then BRA (now BPDA) approved the project in April, 2016, based on the condition that the developer sell two units at “affordable” rates.

Basically, according to the City of Boston, developers of new projects above a certain size have to sell or rent at least 13% of the units at rates for people making no more than the Boston area median income.

The individuals and LLCs named in the suit have until March 2022 to file their responses. You can read the full complaint here.
